Michael Millar is a seasoned attorney with concentrations in professional malpractice litigation, commercial litigation, consumer protection law, environmental law and real estate law.

After graduating from Lafayette College in 1984, Michael served as a captain in the U.S. Army. Michael then attended Vermont Law School, graduating in 1992. There he was a member of the Law Review and interned with the U.S. Department of Justice, Environmental Crimes Section. After law school, Michael clerked in the Superior Court of New Jersey, Atlantic County, for the Hon. Robert Neustadter and the Hon. Arthur Guerrera. He is admitted to practice in New Jersey, New York and Pennsylvania. He is a member of the New Jersey and Ocean County Bar Associations.

Michael began his practice working in criminal defense where he gained valuable trial experience. He has litigated cases involving professional negligence claims, commercial disputes and claims made under the New Jersey Consumer Fraud Act.

Given Michael’s wealth of real estate litigation experience, he brings a unique level of knowledge and expertise to matters involving real estate brokers, title companies, mortgage companies, insurance companies and home inspection companies. Michael has successfully defended licensed professionals in over 100 actions brought in state and federal court.

MICHAEL HAS RECENTLY:

• Successfully represented a large mortgage company against claims made by a borrower of alleged violations of RESPA, TILA and the New Jersey Consumer Fraud Act in the refinancing of a mortgage on plaintiff’s home;
• Obtained summary judgment against a plaintiff for claims made against a real estate broker and its agents relating to the sale of a home alleged to contain “toxic mold”;
• Obtained summary judgment against a plaintiff who claimed a violation of the New Jersey Consumer Fraud Act by a real estate broker and its agents for alleged misrepresentations made concerning the condition of the home;
• Obtained the dismissal of two different actions brought against real estate brokers and their agents for dog bites to social guests of the tenants / dog owners;
• Obtained dismissal against a plaintiff alleging professional malpractice against an insurance broker for the alleged failure to provide adequate counsel and advice relating to commercial construction.
• Obtained dismissal against a plaintiff alleging professional malpractice against title insurance broker where the plaintiff alleged that the title insurer negligently failed to identify the correct parcel of land or pay the correct amount of taxes and liens at closing.
• Obtained a dismissal of a class action lawsuit brought against a title insurance broker alleged to have withheld funds above and beyond the actual costs incurred at closing.
• Successfully defended an adverse possession action brought against the owners of a parcel of commercial property by adjoining landowners.
• Successfully defended a multinational corporation in a products liability matter for the manufacturer of a component part of a refinery.
• Successfully defended a multinational corporation in a products liability matter for the manufacturer of a component part of a machine used to produce envelopes.
• Negotiated contracts related to interstate and international sale, transportation and cryo-storage of donor human ova for use in fertility clinics.
